Dixons Commercial Insurance Brokers is an independent insurance intermediary established in 1981.

We are licensed credit brokers and our Consumer Credit Licence number is 565142.

 

This Terms of Business explains how Dixons Commercial Insurance Brokers works and how this affects you, our client.

 

This Terms of Business will be effective from the date of issue and will remain in force until it is terminated by you or us.  However, we may make amendments at any time.  An amended copy will be sent to you within 10 working days of the changes becoming effective.

 

This Terms of Business contains information about the standard terms and conditions of our dealings upon which we intend to rely.  If there is anything you do not understand or wish to query, please let us know as soon as possible.

 

Our Services

 

We act on your behalf to arrange Insurance. We represent a number of Insurance Companies & Lloyds Syndicates.  You will be told if we are acting on behalf of another intermediary or agent.

 

Our services include:

 

  • Advising you on your insurance needs
  • Arranging your insurance cover with insurers to meet with your requirements
  • Helping and transacting any changes
  • Collecting premiums on behalf of your insurer where necessary
  • Assisting and advising you with regard to making claims

 

We are able to offer a range of commercial and personal insurance products.

 

We are members of the British Insurance Brokers Association. (BIBA)

 

Regulatory Status

 

Dixons Commercial Insurance Brokers is authorised and regulated by the Financial Services Authority.  Our FSA register number is 306297 and this can be checked on the FSA website (www.fsa.gov.uk/register) or by contacting the FSA on 0845 606 1234.

 

 

We will provide you with an Initial Disclosure Document at the commencement of our dealings.  This document sets out the key facts you should be aware of during the dealings you have with us.  The Initial Disclosure Document should be read in conjunction with this Terms of Business.

 

Duty to Give Information

 

It is your responsibility to provide complete and accurate information to insurers when you take out your insurance policy, throughout the life of your policy, and when you renew your insurance.

 

The answers you have given via the Proposal Form or statement of facts will usually provide enough information to enable your Insurer to consider a proposal.  However, because no list of questions can be exhaustive, please consider carefully whether there is any other material information known to you, which could influence their assessment of the risk. 

 

If you are in doubt as to what constitutes a material fact you should consult us.  Failure to comply with this may invalidate your insurance and result in a claim not being paid.  Similarly, any change or alteration to these details should be notified to us as soon as possible, certainly at the time of any policy amendment or the next renewal.

 

Insurers and their agents share information with each other to prevent fraudulent claims and to decide whether to accept your proposal and, if so, on what terms via the Claims and Underwriting Exchange register operated by Insurance Database Services Ltd.  A list of participants is available on request.  In dealing with your application this register may be searched.  In the event of a claim, the information you supply on a proposal form and a claim form, together with other Information relating to the claim, will be put on the register and made available to the participants.

 

Policy Documentation

 

All policies will be registered your name unless otherwise agreed in writing.  Unless you instruct us in writing to the contrary, we will forward to you all documents showing ownership of your policies as soon as practicable after we receive them.  Where a number of documents are involved we will await arrival of them all before sending them to you.

 

Cancellation

 

Insurers practices vary but cancellation refunds are not generally given if a claim has been submitted or a policy has exceeded eight months of cover.   Your Policy Document will provide full details.

 

In order to cancel a policy we will require written confirmation along with your current Certificate of Motor Insurance or Current Cover Note.  In all other cases the refund is calculated on a short period scale in favour of the Insurer as their costs are similar whether a policy has run for one month or twelve.

 

We reserve the right as authorised agents to your Insurer to cancel the policy giving 7 days notice by Recorded post at your last known address.  You will be responsible for premiums due for the time on risk up to the cancellation date.

 

Ongoing Relationship

 

By agreeing to this Terms of Business you agree that there is an ongoing client relationship between us and you.  At our discretion and unless we hear from you to the contrary we may email, telephone or write to you between the hours of 9am and 9pm without your further prior consent.  You agree to us contacting you for the purpose of marketing products we feel could be suitable or of interest to you.

Conflicts of Interest

We undertake not to transact business for you in which we or one of our customers or any partner/employee has a known interest if we become aware that these interests conflict with yours, unless that interest is first disclosed in writing and your consent obtained.

 

Occasions can arise where we or one of our clients may have some form of interest in business that we are transacting for you. If this happens, or we become aware that our interests or those of one of our other clients conflicts with your interests, we will inform you in writing and obtain your consent before we carry out your instructions.  We promise to deal honestly, fairly and professionally with you at all times, including if any material interest or conflict of interest arises.

 

Data Protection

 

During our dealings with you we will need to collect information about you, which we will hold in paper and/or electronic format as data controllers under the Data Protection Act.  We can use this information to analyse your current and future needs so that we can ensure that any advice is suitable to your particular circumstances.  The public register of data controllers can be found at www.ico.gov.uk

 

The FSA requires us to keep records of all our business transactions for at least a set number of years, depending on the type of transaction.  However, we will not keep records longer than is necessary.  

 

You or your appointed agent has the right to inspect all records relating to yourself and your transactions through ourselves and, where appropriate, have it corrected or deleted (if the deletion would not be a breach of any known regulations).  All such requests for information must be referred to the Data Protection Officer at the address mentioned above. 

 

We treat all our clients' records as confidential, so we reserve the right to give you copies of your particular records rather than allowing access to files containing records about other clients. 

 

We will supply the information to you within the required timescale of 40 days and we will charge a fee of £10 for the information.

 

By accepting this Terms of Business:

 

You agree that the information we hold about you can be held on computer and/or paper files.

 

You agree that any information, which you give us, may be disclosed to third parties (e.g. credit reference agencies and product providers) for the purpose of processing your application or to another firm upon the sale of all or part of our business.

 

You agree that we may use the information that we hold about you to contact you from time to time by post, fax, e-mail or telephone to bring to your attention additional products or services, which may be of benefit to you.

 

If you do not wish your data to be held as detailed above or receive contact from us regarding other products and services, please tell us in writing to our address shown above.

 

Termination

 

You or we may terminate this Terms of Business at any time.  Notice of termination by you must be given in writing to the address above.  The Terms of Business will be terminated upon our receipt of your instructions.  Notice of termination by us will also be given in writing and will be sent to your last known address.  Termination of this Terms of Business is without prejudice to the completion of any transactions initiated prior to receipt of such notice. 

 

Call recording

We may record telephone calls and use those recordings for training or regulatory purposes.

 

Law

 

The law governing our ongoing dealings and this Terms of Business is the law of England and Wales.

 

Language

 

All dealings and communications with you will be carried out in English.

 

Taxes

 

Other taxes or costs may exist which are not paid through us or imposed by us.

 

Client Declaration

 

I/We sign this copy of the Terms of Business confirming that I/we understand and are happy to be dealt with under the above terms and am/are agreeable to Dixons Commercial Insurance Brokers acting on my behalf. 

 

I/We authorise them to receive any information they may request about my/our financial affairs.  I/We authorise Dixons Commercial Insurance Brokers to pass information on a confidential basis, when warranted to such companies.

 

I/We agree that this Terms of Business will come into effect from the date of issue and will remain in force until replaced or terminated.
